This privacy policy (“Privacy Policy”) is designed to help you understand how Lively, LLC (“we”, “Lively”, “us”) collects, uses and shares information that we or our third-party partners may collect from you when you access our website or use our mobile apps. For the purposes of the Privacy Policy, we will call our website, apps and all corresponding support and interactions with you the “Lively Platform”, or “LP”. By using the LP, you agree to the terms of this Privacy Policy.
1. What Information may Lively collect?
We may receive and store Personal Information, Financial Information and/or Non-Personal Information (collectively “Information”) that you provide when you interact with Lively.
- “Financial Information” is information relating to payments and billing (e.g. name, account information, billing address, payment processing data).
- “Non-Personal Information” is information about a user, but by itself does not identify a specific individual (e.g. demographic information, usage data, device hardware and software data, broad geographic location, and download history).
- “Personal Information” is information that specifically identifies an individual (e.g., name, mailing address, GPS location, your device’s persistent device identifier, email address or phone number).
2. How does Lively collect Information?
We collect Information through your use of the LP, when you connect to partner service providers, and communicate with us. Here are a few examples of when we may collect Information:
- When you contact us by phone, email, our contact page or other means. If we know that you are under the age of 13, we will delete your Personal Information once your request has been fulfilled.
- When you create an account on the LP.
- When you purchase products or services in or through the LP or through our third-party providers. In most cases, we use third-party service providers, such as Apple, Google and PayPal, to handle all Financial Information related to such transactions.
- When you connect the LP to third-party services and networks such as Facebook, Twitter, Apple, Game Center, and Google+.
- When you sign in to the LP using an Open ID provider (such as Facebook Connect or Twitter) that authenticates your identity and provides you with the option to share certain Personal Information with Lively, such as your name and email address. Services like Facebook Connect give you the option to post information about your activities on the LP to your profile page to share with others within your network.
- When you interact with our third party service providers.
- Lively works closely with a variety of artists/bands and other rights holders (like record labels, bands and music publishers) (“Rights Holders”). Rights Holders, whether individually or in conjunction with Lively, may offer to sell you products and services through the LP. If you opt-in, we may share Personal Information with Rights Holders.
3. Will Lively ask my permission before collecting Information?
We will only collect Personal Information and Financial Information about you when you volunteer it or opt-in to collection. Keep in mind that some features and functionalities of the LP may be unavailable if you choose not to share certain Information.
By using the LP, you are consenting to Lively collecting Non-Personal Information without any further permission or notification. Lively may collect Non-Personal Information directly from you, through our third party service providers, or automatically through tools including, but not limited to, cookies, web beacons, and analytics programs embedded within the LP.
The LP may contain links to other sites that are not owned or controlled by Lively. Please be aware that we have no control over these sites and are not responsible for the privacy practices of such other sites. This Privacy Policy applies only to information collected by the LP.
4. Does Lively collect Information from/about minors?
We do not knowingly collect Personal Information from persons under the age of 13 without parental consent. If it comes to our attention that Personal Information has been collected from a person under the age of 13, we will delete this Information as quickly as possible. 5. How does Lively protect my Information?
Lively follows generally accepted industry standards to protect against unauthorized access or disclosure. For Lively, this includes, but is not limited to, ensuring that all Personal Information and Financial Information is collected via encrypted connection (using secure socket layer technology, “SSL”) and is disclosed only on a “need to know” basis. However, we cannot guarantee absolute security of Information because no method of transmission over the Internet or electronic storage is 100% secure. While the collection and use of Information by third-parties is not covered by this Privacy Policy and we cannot be responsible for the practices of such third parties, we do take commercially reasonable efforts to only work with third-parties that respect the privacy of your Information.
6. What does/may Lively do with my Information?
The primary reasons we collect Information are to provide the LP, improve our service offerings and communicate with you regarding your use of the LP. As a general matter, we do not sell, and typically will not disclose, your Personal Information to third parties without your consent (See Section 7). Here are a few examples of what we do with Information:
- We may use your Information in conjunction with monitoring system performance, analyzing internal business systems, improving the LP, fulfilling requests for additional products and conducting research.
- We may use your Personal Information to contact you about the LP, including promotions and events. You can opt out of receiving promotional emails by following the instructions in the relevant correspondence. Once we have processed your opt-out request, we will not send you further correspondence unless you later opt back in. That said, we reserve the right to contact you with respect to important information, notices or changes relating to the LP.
- We may use your Personal Information to send you push notifications regarding events and promotions, as well as other account information that may be important to you. You may opt-out from receiving these communication by turning them off at the device level through the settings of the device or by contacting us at support@getlive.ly
- We may use Information in conjunction with serving you ads and ad-relating features in the LP. For example, we, or our third-party ad providers, may use cookies that allow us to recognize your device each time you use the LP or receive an online ad. This allows ad servers to compile information about your viewing and interaction with their ad and deliver targeted ads that they believe will be of most interest to you. This Privacy Policy does not cover the use of cookies by any advertisers, and we encourage you to review the applicable advertiser’s website for their privacy policy.
- We may use Information to integrate social media features and tools, such as the Facebook “Like” button, or the YouTube “share this” button. These features may collect information on your IP address and viewing history, and may set a cookie to enable the feature to function properly. Social media features and tools are either hosted by a third party or hosted directly on the LP. Your interactions with these integrated social media features and tools are governed by the privacy policy of the company providing the social media feature.
- We may use Information in order to investigate, prevent or take action regarding illegal activities, suspected fraud, and situations involving potential threats to the physical safety of any person, violations of Our Terms of Use located at http://www.getlive.ly/terms-of-use/ or as otherwise required by law.
7. Under what circumstances will Lively disclose my Information to third parties?
Lively reserves the right to disclose Non-Personal Information at its discretion and without limitation. However, we will not disclose your Personal Information or Financial Information except in the following circumstances:
- We may share Information in relation to any of the situations listed in Section 6 above.
- Third-Party Service Providers. We may use third-party companies and individuals to perform functions on our behalf. Examples include fulfilling orders, processing payments, hosting, data storage, sending postal mail and email, removing repetitive information from customer lists, analyzing data, providing marketing assistance, providing search results and links (including paid listings and links), processing credit card payments, and providing customer service. We will provide such entities with access to Information needed to perform their functions, but will take measures to ensure that they may not use it for other purposes.
- Legal. We may disclose Information to respond to subpoenas, court orders and other legal process, and to establish/exercise our legal rights. We may also disclose your Information to defend against legal claims when we believe that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request.
- Business Transfers. We may reorganize as a business entity, acquire entities, subsidiaries, or business units, or enter into joint ventures with third parties. In any of these types of transactions, any information you provide may be one of the transferred business assets. In the event that we are acquired, our assets are acquired, or we merge with a third party, your information will likely be a transferred assets. We reserve the right to transfer any information collected from you in the case of any such event.
- With Your Consent. There may be additional instances where you or Lively may wish to allow disclosure of Personal Information and Financial Information about you. We may make such disclosures with you consent.
8. Does Lively ever update the Privacy Policy?
We may update the Privacy Policy to reflect changes to our information privacy practices. If we make any material changes we will add a notice regarding the change on our website www.lively.com prior to the change becoming effective. We may also email you. We encourage you to periodically review this page for the latest information on our privacy practices.
9. Where is my Information being stored?
The LP is hosted in the USA. If you are accessing the LP from the EU, Asia, Canada, or any other region with laws or regulations governing personal data collection, use, and disclosure that differ from the laws of the USA, then please note that you are transferring your personal data to the USA, which does not have the same data protection laws as other regions.
